$5 Million Settlement – Construction Equipment Incident Causes Severe Injuries

Our client, a 52-year-old construction supervisor, was catastrophically injured while working at a construction site. During the project, a 30,000-pound telescopic forklift rolled downhill after its parking brake was inadvertently disengaged by a subcontractor’s employee. The equipment struck a portable restroom where our client was located, pinning him between the forklift and a parked utility truck.

As a result of the incident, our client sustained a traumatic brain injury, cervical and lumbar spine damage, hip and wrist injuries, and multiple orthopedic and neurological complications. He underwent multiple spinal surgeries, was declared totally disabled by the Social Security Administration, and continues to receive treatment through workers’ compensation.

The subcontractor failed to follow safety protocols, including parking the equipment on a slope without wheel chocks. The equipment rental company also delivered the forklift with a defective parking brake.
