Our client, a first time mother, had an uneventful pregnancy. When she went to the hospital to give birth, it was discovered that the baby was in breach (presented feet first, instead of head first). Instead of preforming a C-Section as is the standard of practice, the doctor decided to try to vaginally deliver the baby, resulting in the baby being stuck in the birth canal for a prolonged period which caused the baby to lose oxygen and sustain a mild brain injury.
